执法规范化建设活动开展以来,赣县公安局立足基层执法单位的实际和深化警务改革的要求,把能力建设做为根本,紧紧围绕保障能力、监督能力、执行能力、管理能力、服务能力建设要求,采取网络化设置、数字化考评、规范化建设、常态化培训、制度化监督、人性化操作的“六化”措施,强化细节管理、落实规范要求、实现素质养成,深入落实执法规范化要求,取得了显著的效果。2012年3月6日,该局被省公安厅授予“全省公安机关推动执法规范化建设红旗单位”。4月20日,被市公安局授予“全市公安机关推动执法规范化建设红旗单位”和“全市公安机关执法质量排头兵”两项荣誉奖牌,2010年、2011年该局执法质量工作连续两年位居全市第一。
一、专兼职法制员“网络化”。
为适应信息化、法制化、全球化时代对执法工作的新要求,该局始终把基层法制员队伍建设作为落实执法规范化建设的“第一工程”,明确提出打造基层一流法律“智囊团”的目标。每个基层办案单位均至少配备一名学历高、业务能力强、办案经验丰富的民警为专职法制员,并结合本局特点,该局法制大队法制民警分片管理、指导基层法制员日常法制工作,实行分类分层的管理方式,落实监督、保障和服务措施,有效解决了执法各层面的有效衔接和案审准确性问题,实现了以法制员为点,以警种为战线,涵盖全局法制工作的“点线面”全覆盖格局。
二、执法质量考评“数字化”。
该局紧紧把握执法质量这条生命线,充分依托公安信息化建设载体,以综合警务执法平台为基础,把实行“考核考评”作为执法质量监督的重要抓手。全面落实“执法信息网上录入、执法流程网上管理、执法质量网上考核、执法活动网上监督、执法档案网上建立”要求,建立了完善的民警执法电子考评档案,实行“每一起案件、每一个人犯、每一本卷宗、每一个疑点”的全程跟踪考评。对考评过程中发现的共性类和个性类问题,采取每日一通报、每案一通报,每月一考核的措施,及时纠偏、告知、补救和警示。对发现的疑难案件开展集体案审,进行释疑解惑、专题讲解、专案分析。实现以考促改、以考促建、以考促用。同时,该局于今年6月11日开通了赣县公安局法制网,网站下设案例点评、法律法规、通知通报、执法监督、复议应诉、劳教工作、法制在线等栏目,法制大队在线解答执法单位和民警在执法办案中遇到的疑难问题,及时汇总、分析和解决网上提出的带有普遍性的问题,把考核考评与整改整顿有机结合,实现考核考评更量化、更透明、更清晰。
三、办案分区建设“标准化”。
该局把执法硬件建设作为落实规范化的重中之重,没有因为办公用房紧张、资金短缺而降低建设标准、放慢建设步伐。该局为全面完成执法办案场所功能分区改造任务,制定了该项目历程表,明确各场所建成时间,并于每月将该表进行通报,并纳入年底执法考评。按照《公安机关执法办案场所设置规范》要求,落实推进执法活动场所功能划分,明确了讯问室、询问室、候问室、监控室的建设要求,重点对接待区、办案区,规范岗位设置,明确工作标准,完善装备配备,建成的标准办案区,全面实行数字化、人性化、标准化设计,实现区内办案、留置、取证,确保工作安全。同时,该局还建立完善各种办案区管理制度、档案、操作规范,办案分区建设成为该局执法规范化建设的一个最大亮点和落实从优待警的一个最实举措。
四、执法技能培训“常态化”。
他们把执法技能培训作为执法规范化建设的重要环节,针对警务改革后民警综合执法的需要,把培养“全能警”作为执法素质培训的重点,以实战为需、以能力为根、以规范为本,从警务规范入手,采取“上讲台、上网络”等多种方式,实施民警执法技能培训的常态化。年初该局就制定法律知识学习专项培训活动实施方案,遵循“干什么、练什么,缺什么、补什么”的原则,每月开展相关业务培训、组织全体民警深入学习《公安机关执法细则》、《刑事诉讼法》(修订版)等相关业务技能。
五、执法行为管理“制度化”。
他们在强化软硬件保障和素质建设的基础上,把强化执法监督作为民警执法行为管理的重要手段,用严格的管理、严肃的纪律、严明的约束建立执法“高压线”,实现用制度管人、用机制管事、用规范管心。针对办案过程中的易出问题环节,设置案件“六级审核把关制度”,杜绝暗箱操作;为加快办案进度,缩短办案周期,着力解决少数民警在办案过程中的“等、推、拖”现象,进一步增强民警依法办案意识和责任感,在保证办案质量的基础上,全力推行《刑事案件催办制度》。同时,还依托警风警纪监督员制度、警企座谈会制度、内务管理督察制度等内外监督制约机制,实现对民警执法行为的有效监督管理,切实规范民警的执法行为。
六、执法行为过程“人性化”。
在推进执法规范化建设中,他们始终立足于“理性、平和、规范”的人性化执法要求,把推行充满人情味儿的理智理性人性化执法作为规范执法行为的根本行为准则。从思想理念引领、执法措施落实和执法行为评价几方面入手,加以引导、督促和规范。针对辖区纠纷类案件多的实际,坚持“先调后处、多调少处”的原则,主动开展矛盾化解。在推进管理的执法活动中,紧紧抓住服务民生主线,使执法思路更加清晰、执法方式更加灵活、执法行为更加理性,收到了良好的执法效果。

Since the launch of law enforcement standardization activities, the Ganxian County Public Security Bureau has based itself on the reality of grassroots law enforcement units and the requirements of deepening police reform, and has taken capacity building as the foundation, focusing on the construction of support capabilities, supervision capabilities, execution capabilities, management capabilities, and service capabilities. Requirements, adopt the “six modernizations” measures of network setting, digital evaluation, standardized construction, normalized training, institutionalized supervision, and humanized operation, strengthen detailed management, implement normative requirements, realize quality development, and thoroughly implement standardized law enforcement requirements. Remarkable results have been achieved. On March 6, 2012, the bureau was awarded “the red flag unit of the province’s public security organs to promote the standardization of law enforcement” by the Provincial Public Security Department. On April 20th, it was awarded two honorary medals by the Municipal Public Security Bureau, “the red flag unit of the city’s public security organs to promote the standardization of law enforcement” and “the vanguard of the city’s public security organs in law enforcement quality”. In 2010 and 2011, the law enforcement quality work of the bureau ranked first No. 1 in the city.
1. “Networking” of full-time and part-time legal officers. In order to meet the new requirements for law enforcement in the era of informatization, legalization, and globalization, the Bureau has always regarded the construction of grassroots legal officers as the “first project” to implement the standardization of law enforcement, and clearly proposed the goal of building a grassroots first-class legal “think tank” Target. Each grass-roots case-handling unit is equipped with at least one police officer with a high degree of education, strong professional ability, and rich experience in handling cases as a full-time legal officer. 3. “Standardization” of case-handling zoning construction. The bureau regards the construction of law enforcement hardware as the top priority of implementing standardization, and has not lowered construction standards or slowed down the pace of construction due to shortage of office space and shortage of funds. At the same time, the bureau has also established and improved various case-handling area management systems, files, and operating specifications. The construction of case-handling divisions has become the biggest highlight of the bureau’s law enforcement and standardization construction and the most practical measure to implement preferential treatment of police.
4. “Normalization” of law enforcement skills training. They regard law enforcement skills training as an important link in the standardization of law enforcement. In response to the needs of the police for comprehensive law enforcement after the police reform, they regard the training of “all-round police” as the focus of law enforcement quality training. This book, starting from the police norms, adopts various methods such as “on the podium and on the Internet” to implement the normalization of police law enforcement skills training. At the beginning of the year, the bureau formulated the implementation plan for special training activities for legal knowledge learning, followed the principle of “what to do, what to practice, what is lacking, and what to make up”, carried out relevant business training every month, and organized all police officers to study in depth the “Detailed Rules for Law Enforcement of Public Security Organs”, ” Criminal Procedure Law (Revised Edition) and other related business skills.
5. “Institutionalization” of law enforcement management. On the basis of strengthening software and hardware guarantees and quality building, they regard strengthening law enforcement supervision as an important means of police law enforcement behavior management, and use strict management, serious discipline, and strict constraints to establish a law enforcement “high-voltage line” to achieve system management. Use mechanisms to manage affairs, and use norms to manage your heart. Aiming at the problem-prone links in the process of handling cases, set up a “six-level review and check system” for cases to eliminate black-box operations; in order to speed up the progress of case-handling and shorten the cycle of case-handling, focus on solving the phenomenon of “waiting, pushing, and delaying” by a small number of policemen in the process of handling cases , further enhance the awareness and sense of responsibility of the police in handling cases according to law, and fully implement the “Criminal Case Reminder System” on the basis of ensuring the quality of case handling. At the same time, it also relies on the internal and external supervision and control mechanisms such as the police discipline supervisor system, the police enterprise forum system, and the internal affairs management supervision system to achieve effective supervision and management of the police’s law enforcement behavior and effectively regulate the police’s law enforcement behavior.
Sixth, the process of law enforcement is “humanized”.
