赣县公安局执法规范化建设工作方

为全面推动执法规范化建设,不断提高全县公安机关的执法能力、执法质量和执法水平,根据公安部《关于大力加强公安机关执法规范化建设的指导意见》、《全国公安机关执法规范化建设总体安排》、和《江西省公安机关执法规范化建设工作方案》,特制定以下工作方案。

一、指导思想和工作目标

以邓小平理论和“三个代表”重要思想为指导,深入贯彻落实科学发展观,坚持依法治国基本方略,以适应时代发展新要求、满足人民群众新期待为出发点,以全面提高执法能力和执法公信力,以解决执法突出问题为突破口,以“巩固、完善、提高”为原则,将执法规范化建设与公安信息化建设、构建和谐警民关系紧密结合起来,全面提升我局执法规范化建设水平,进一步推动我局工作又好又快发展。

二、组织领导

县局成立由县委常委、公安局长黄严生任组长,局党委副书记、政委刘震民任常务副组长,其他局党委成员任副组长,局各有关单位主要负责人为成员的执法规范化建设领导小组,负责执法规范化建设工作的规划、组织、督导。领导小组下设办公室,办公室主任由局党委委员、副局长黄浩兼任,副主任由法制室主任邓建中兼任,办公室设在法制大队,从局主要业务部门抽调人员,具体负责全局执法规范化建设的组织实施、指导协调、情况掌握、综合分析等工作。局各有关业务部门要成立相应的领导、工作机构,制定加强执法规范化建设的实施方案,确定联络员,定期向局执法规范化建设领导小组办公室汇报推进执法规范化建设工作的情况,形成党组统一领导、主要领导负总责、分管领导具体抓,业务部门各司其职、警种之间联动协作、条块结合的工作格局。

三、工作部署

(一)部署学习阶段(7月30日前)

县局各部门、警种要继续深入学习贯彻公安部《关于大力加强公安机关执法规范化建设的指导意见》、《全国公安机关执法规范化建设总体安排》和《江西省公安机关执法规范化建设工作方案》,将执法规范化建设的重要意义、基本要求和工作部署传达到每一名民警,并按照本工作方案,进一步明确目标任务、责任分工及工作要求,迅速掀起执法规范化建设的新高潮。

(二)实施提高阶段(8月至10月)

县局各部门、警种要认真排查本部门、警种执法工作中存在的不严格、不公正、不规范、不到位等问题,从暴露出的问题和漏洞入手,分析发生问题的深层次原因,找准对策,建立健全相关的执法制度和执法规范,努力从根本上解决执法工作中存在的突出问题,及时收集总结执法工作方面的好经验、好做法、好制度,并加以推广。

(三)检查总结阶段(11月至12月)

县局将组织对各部门、警种的执法规范化建设情况进行检查,并在2012年11月前,将情况汇总报送市局执法规范化建设领导小组办公室。

四、主要任务

(一)大力加强执法思想建设

1、大力开展社会主义法治理念教育和深入学习实践科学发展观等活动。

教育广大民警牢固树立执法为民的思想,积极实践科学发展观,善于用和谐的理念来指导执法工作,把维护社会公平正义作为公安执法工作的首要价值追求。

2、加强民警职业道德教育。

使各级领导和广大民警把尊重法律、敬畏法律、捍卫法律、忠于职守作为公安民警职业道德的底线,成为忠于党、忠于祖国、忠于人民、忠于法律,有除暴安良之志,有恪尽职守之德,有规范执法之能,以维护公平正义为己任的模范执法者。

3、深入开展典型引路和警示教育。

各单位要收集、整理、剖析本地区及本部门、警种近期发生的社会影响较大的正反两方面的典型案(事)例,组织广大民警学习、讨论。通过正面典型引路和反面典型警示两个方面,特别是运用构建和谐警民关系的先进事迹和执法示范单位的先进经验,以及引起社会舆论高度关注的执法不规范的案(事)件开展教育活动,帮助民警提高规范执法的自觉性。

(二)大力加强执法主体建设

4、加强执法教育培训。

把加强执法主体建设作为一项基础性、战略性、长效性的工作放在优先发展的位置,加大执法培训力度,全面落实“三个必训”、领导干部法律学习培训等制度,全面实施集中教育训练与岗位自学自练有机结合、轮值轮训等经常性练兵机制。2012年,要重点围绕执法中的突出问题,对基层公安机关领导和一线民警集中进行规范执法培训,并形成长效机制。在执法培训中,要把法律要求、制度规范、案例剖析和实战训练紧密结合起来,努力提高各级公安机关领导干部和广大民警的执法规范化、专业化、标准化水平。

5、举办执法规范化建设讲座。

针对当前公安执法办案中存在的突出问题,采取案例教学的方式,举办执法规范化建设讲座。通过对典型案例的剖析,查找执法问题,分析原因,讲解规范的做法,帮助广大民警进一步提高执法办案能力。

6、完善庭审旁听制度。

对于重大、典型、特殊的案件,组织办案民警集中参加法庭庭审旁听,增强民警对法律法规、如何收集证据的理解和运用的能力。

7、建立公安机关执法资格考试制度。

逐步提高执法岗位门槛,做到凡从事执法工作的民警必须取得相应执法岗位的执法资格,确保执法主体合格。同时鼓励广大执法办案民警参加国家司法考试,提高自身执法素质,对通过考试的民警给予适当的奖励。

8、建立专门人才库。

建立执法专业人才库,充分发挥专门人才在执法办案中的指导作用。

9、加强对雇员、治安员、交通协管员、户管员等执法辅助人员的管理。

结合我县实际,制定执法辅助人员管理相关规定,对执法辅助人员的录用、管理、职责、待遇、纪律等方面予以明确规范,严禁其在没有民警带领的情况下单独从事执法活动。

10、加强民警执法权益保护。

健全民警权益保护机制,理顺维权工作流程,建立健全工作网络,充分保障民警执法权益。进一步加强维权教育培训,通过在新警上岗、警衔晋升和实战训练中开设维权课程,增强民警自我保护和依法维权意识。同时,加大执法维权工作的社会宣传力度,培育尊重民警执法权益的社会氛围。

(三)大力加强执法制度建设

11、解决执法突出问题。

从基层民警日常执法活动最急需的问题入手,对民警在执法实践中可能遇到的各种复杂、疑难问题进行全面梳理,细化各类执法标准,制定具体明确、通俗易懂、便于操作的执法指引,下发至基层单位和一线民警,为基层执法工作提供法律上、制度上、规范上的保障和支持。

12、制定、完善执法制度。

各单位要认真查找本地区、本部门、本警种执法规范化建设中的薄弱环节和空白点,特别是要针对当前执法活动中最容易发生问题的环节开展调研,对调研发现的薄弱环节和空白点研究制定明确的操作程序和执法标准,完善各种管理制度,确保民警在各项执法活动中、各个执法环节上都有法可依、有章可循。

(四)大力加强执法行为规范化建设

13、完善案件法律审核把关制度。

按照“谁审批,谁负责”、“谁执法,谁负责”、“职权与责任相统一”的原则,进一步明确法律审核把关的主体、确定把关的案件范围和执法环节,完善案件法律审核制度。要建立不同意见备案制度,将法律审核、案件审议中的不同意见记录在案,作为执法检查和责任追究的依据。对因未采纳正确意见而导致错案的,不追究提出正确意见人的责任。要加强基层股所队兼职法制员建设,充分发挥其在案件审核把关中的重要作用。

14、开展规范自由裁量权工作。

各单位要继续抓好规范自由裁量权工作,根据社会经济发展实际,细化、量化行政裁量权,明确具体执法标准,缩小自由裁量权空间,做到执法法律效果与社会效果相结合,让人民群众满意。

15、广泛开展执法示范单位培养、创建活动。

选择执法基础较好的基层所队,下大力气培养、创建不同层次的执法示范单位,使基层公安机关和广大民警身边有看得到学得到的榜样。同时,注意认真总结、及时推广执法示范单位的先进经验,并将这些先进经验和成熟做法上升为规范、制度。

16、建立和完善执法工作外部协调机制。

加强与检察院、法院、物价等部门的沟通和交流,充分利用公检法联席会议、物价鉴定工作协调会等平台和外部资源,加强对公安执法问题的调研和磋商,适时出台相应的指导性意见,进一步推进执法规范化建设。

(五)大力加强执法监督体系建设

17、完善警务公开制度。

各单位要对照《政府信息公开条例》的要求,清理应当公开而未公开的执法信息。在此基础上,进一步建立健全政府信息公开工作考核制度、执法信息公开审查制度、社会评议制度和责任追究制度,全面推行执法告知、治安案件公开调解、劳教案件公开聆讯、火灾和道路交通事故公开认定、疑难信访案件公开听证等公开制度,保障当事人在执法工作中的参与权。

18、深化执法质量考评工作。

逐步形成从静态考评到动态考评,从结果考评到源头考评,从事后考评到过程考评的考评新机制。全面建立单位及其领导和民警个人执法档案,规范执法案卷,推行一案一评和一事一评,客观、真实、准确记录每个民警和执法单位的执法情况以及有关考核、奖惩情况,作为晋职、晋级、评先创优的重要依据。

19、完善个案监督和执法过错责任追究制度。

抓紧建立个案执法监督和执法过错责任追究启动机制,健全个案监督程序,充分发挥警务督察部门的现场监督作用和法制部门的内部执法监督作用,确保执法过错责任追究制度严格落实。要在坚决纠正执法过错的同时,坚决追究审批人、审核人和承办人的责任,促使领导和民警自觉依法办事。

20、加强行政复议、应诉和国家赔偿工作。

要进一步规范案件办理程序,建立健全行政复议听证、调解、和解制度,进一步提高案件办理质量,充分发挥化解行政争议、促进社会稳定和谐的积极作用。要进一步完善办案协作机制,通过下发行政复议意见书、行政复议建议书,积极组织开展案例点评、公安机关负责人出庭应诉等活动,不断深化案件办理的效果,促进公安机关执法质量和执法水平的提高。

(六)大力加强执法工作信息化建设

21、推行网上执法考评。

全面实现上级公安机关对下级公安机关、各级公安机关对所属执法部门及民警的全方位、全过程的执法质量网上考评,实现考核数据的自动采集、生成和核对,克服人工考评的弊端,降低考评成本,提高考评结果的公信力。

22、加强执法监督信息化管理。

按照“以警为本,重在预防”的理念,加强执法监督信息系统建设,进一步延伸网上督察的触角,扩大监督范围,丰富监督内容,进一步用好、用足网上监督手段,形成科学高效的网上监督机制。

23、强化网上法律服务。

加强法制网站建设,完善法规查询、执法问答、执法情况反馈等功能,积极探索建立长期、规范的网上法律服务工作机制,通过网上法律咨询、法律法规汇编、典型案例评析、以案释法等形式,为基层执法提供更加及时、便捷、有效、可靠的法律服务和保障。

五、工作要求

(一)统一思想,提高认识。

加强执法规范化建设是公安机关深入学习实践科学发展观的一项重大举措,是提高公安机关执法公信力的重要途径。各单位要把加强执法规范化建设作为事关公安工作和公安队伍建设全局的大事来抓,作为当前一项十分重要而紧迫的任务来部署,切实加强组织领导,组织专门力量,精心部署,全面推进。

(二)科学规划,周密安排。

各单位要以科学发展观为指导,用科学的精神、科学的思维来谋划推动执法规范化建设,既要突出重点,又要系统考虑;既要抓紧工作,又要避免急功近利,保证执法规范化建设始终沿着正确的方向发展,符合社会发展的客观规律和公安工作、队伍建设的客观要求。

(三)整改问题,完善制度。

各单位要坚持“边整改、边建制”的原则,一手抓执法突出问题整改,一手抓执法制度建设。对发现的执法问题,能立即整改的,要及时整改;对一时难以整改的,要落实整改责任制,限期整改。对带有普遍性的执法问题,要制定整改计划,逐项整改解决。要把执法制度建设与深入学习实践科学发展观活动、党风廉政建设、开展执法质量考评,以及各项公安工作紧密结合起来,确保执法规范化建设全面发展。

(四)加强督导,务求实效。

县局将把组织开展执法规范化建设作为督导的主要内容,深入基层,深入实际,进行检查指导、考试考核。要建立奖惩通报制度,对工作扎实、成效显著的,予以表彰奖励;对措施不力、成效不大的,予以通报批评。要把组织开展执法规范化建设的实际成效,纳入领导干部绩效考核范围,作为评价领导干部政绩、晋职晋级和奖励惩处的重要依据。

(五)统筹兼顾,长远规划。

各单位要处理好阶段性工作与长效机制建设的关系,充分认识到执法规范化建设的必要性和迫切性,增强执法制度建设的责任感和紧迫感。要清醒地认识到执法制度建设的艰巨性和长期性,进一步建立完善各项执法制度。在执法规范化建设上,要有长远规划,又要从当前需要解决的突出问题和加强薄弱环节入手,力争在近期取得明显成效。要深化理性思考,努力总结规律,善于把基层成功的执法实践经验转化为规范执法行为的制度、规范,形成执法规范化建设的长效机制。正确处理好当前需要解决的突出问题和长期执法规划之间的关系,有效促进执法公正,提高公安机关执法公信力。

(六)抓好宣传,营造氛围。

各单位要结合本地区、本部门、本警种实际,积极探索,大胆创新,利用各种行之有效的方式和载体,大力宣传公安机关开展执法规范化建设的根本目的、重大意义、基本要求和主要任务,宣传执法规范化建设的进展情况、好的经验做法、工作成效和涌现出来的先进典型,通过加大对内对外宣传,引领舆论导向,为执法规范化建设开展营造良好的宣传平台和舆论氛围。

(七)及时沟通,共同推进。

执法规范化建设任务繁重,各单位要与县局执法规范化建设领导小组办公室加强联系,保持良好的互动沟通,对工作中好的经验和做法以及采取的措施要及时整理上报。各单位要确定1名民警作为执法规范化建设工作的联络员,负责本单位的材料报送和协调工作。

In order to comprehensively promote the standardization of law enforcement and continuously improve the law enforcement capabilities, quality and level of law enforcement of the public security organs in the county, according to the Ministry of Public Security’s “Guiding Opinions on Vigorously Strengthening the Standardization of Law Enforcement in Public Security Organs” and “Overall Arrangements for the Standardization of Law Enforcement in National Public Security Organs” , and the “Jiangxi Provincial Public Security Organ Law Enforcement Standardization Construction Work Plan”, the following work plan is specially formulated.
1. Guiding ideology and work objectives
Guided by Deng Xiaoping Theory and the important thought of the “Three Represents”, thoroughly implement the Scientific Outlook on Development, adhere to the basic strategy of ruling the country according to law, take adapting to the new requirements of the development of the times and meeting the new expectations of the people as the starting point, and comprehensively improve law enforcement capabilities and law enforcement credibility , take solving outstanding problems in law enforcement as a breakthrough point, and take “consolidation, improvement, and improvement” as the principle to closely combine the standardization of law enforcement with the construction of public security information and the establishment of a harmonious relationship between the police and the people, so as to comprehensively improve the level of standardization of law enforcement in our bureau and further promote it. The work of our bureau is developing well and fast.
2. Organizational leadership
The county bureau was established with Huang Yansheng, member of the Standing Committee of the County Party Committee and director of the Public Security Bureau, as the team leader, Liu Zhenmin, deputy secretary of the party committee and political commissar of the bureau, as the executive deputy team leader, and other members of the party committee of the bureau as deputy team leaders, and the main leaders of the relevant units of the bureau as members. 3. Work deployment
(1) Deployment and learning phase (before July 30)
All departments and police types of the county bureau should continue to study and implement the Ministry of Public Security’s “Guiding Opinions on Vigorously Strengthening the Standardization of Law Enforcement of Public Security Organs”, “Overall Arrangement for the Standardization of Law Enforcement of Public Security Organs across the Country” and “Work Plan for Standardization of Law Enforcement of Public Security Organs in Jiangxi Province” , communicate the significance, basic requirements and work deployment of law enforcement standardization to every policeman, and further clarify the target tasks, division of responsibilities and work requirements in accordance with this work plan, and quickly set off a new upsurge in law enforcement standardization construction.
(2) Implementation and improvement stage (August to October)
All departments and police types of the county bureau should carefully investigate problems such as laxity, unfairness, irregularity, and inadequacy in the law enforcement work of the department and police types, and start from the exposed problems and loopholes to analyze the deep-seated causes of the problems , Identify countermeasures, establish and improve relevant law enforcement systems and law enforcement norms, strive to fundamentally solve outstanding problems in law enforcement work, collect and summarize good experience, good practices, and good systems in law enforcement work in a timely manner, and promote them.
(3) Inspection summary stage (November to December)

4. Main tasks
(1) Vigorously strengthen the ideological construction of law enforcement
1. Vigorously carry out activities such as education on the concept of socialist rule of law and in-depth study and practice of the Scientific Outlook on Development. Educate the majority of civilian police to firmly establish the idea of law enforcement for the people, actively practice the scientific concept of development, be good at using the concept of harmony to guide law enforcement work, and regard maintaining social fairness and justice as the primary value pursuit of public security law enforcement work.
2. Strengthen police professional ethics education. Make leaders at all levels and the general police regard respecting the law, awe of the law, defending the law, and being loyal to their duties as the bottom line of the professional ethics of the public security police, and become loyal to the party, loyal to the motherland, loyal to the people, and loyal to the law. 3. Carry out in-depth typical guidance and warning education. (2) Vigorously strengthen the construction of law enforcement entities
4. Strengthen law enforcement education and training. Put strengthening the construction of law enforcement subjects as a basic, strategic, and long-term work as a priority for development, increase law enforcement training, and fully implement the “three mandatory trainings” and legal study and training for leading cadres. Implement regular training mechanisms such as the organic combination of centralized education and training and on-the-job self-study and self-training, and rotation training. In 2012, it is necessary to focus on prominent problems in law enforcement, conduct standardized law enforcement training for the leaders of grassroots public security organs and front-line police officers, and form a long-term mechanism. In law enforcement training, it is necessary to closely combine legal requirements, system norms, case analysis and actual combat training, and strive to improve the standardization, specialization, and standardization of law enforcement by leading cadres of public security organs at all levels and the general police.
5. Hold lectures on the standardization of law enforcement. Aiming at the outstanding problems in the current public security law enforcement and case handling, the method of case teaching is adopted to hold lectures on the standardization of law enforcement. Through the analysis of typical cases, find out the problems of law enforcement, analyze the reasons, explain the normative practices, and help the general police to further improve the ability of law enforcement and case handling.
6. Improve the court hearing system. For major, typical, and special cases, the police handling the case are organized to participate in the court hearings, so as to enhance the police’s ability to understand and use laws and regulations and how to collect evidence.
7. Establish a law enforcement qualification examination system for public security organs. Gradually raise the threshold for law enforcement posts, so that all policemen engaged in law enforcement work must obtain the law enforcement qualifications for the corresponding law enforcement posts to ensure that the law enforcement subjects are qualified. At the same time, the majority of law enforcement and case-handling police officers are encouraged to participate in the national judicial examination to improve their own law enforcement quality, and appropriate rewards are given to police officers who pass the examination.
8. Establish a specialized talent pool. Establish a law enforcement professional talent pool, and give full play to the guiding role of specialized talents in law enforcement and case handling.
9. Strengthen the management of law enforcement support personnel such as employees, security officers, traffic coordinators, and household managers. In light of the reality of our county, formulate relevant regulations on the management of law enforcement support personnel, clearly regulate the recruitment, management, responsibilities, treatment, and discipline of law enforcement support personnel, and strictly prohibit them from engaging in law enforcement activities alone without the leadership of the police.
10. Strengthen the protection of the rights and interests of the police in law enforcement. Improve the protection mechanism for the rights and interests of the police, straighten out the rights protection work process, establish and improve the work network, and fully protect the rights and interests of the police in law enforcement. Further strengthen the education and training of rights protection, and enhance the self-protection and law-based rights protection awareness of police officers by offering rights protection courses for new police officers, promotion of police ranks, and actual combat training. At the same time, increase the social publicity of law enforcement and rights protection work, and cultivate a social atmosphere that respects the law enforcement rights and interests of civilian police.
(3) Vigorously strengthen the construction of law enforcement system
11. Solve outstanding problems in law enforcement. Starting from the most urgent issues in the daily law enforcement activities of the grassroots police, comprehensively sort out various complex and difficult problems that the police may encounter in law enforcement practice, refine various law enforcement standards, and formulate specific, clear, easy-to-understand and easy-to-operate policies Law enforcement guidelines are issued to grassroots units and front-line police to provide legal, institutional, and normative protection and support for law enforcement at the grassroots level.
12. Formulate and improve the law enforcement system. All units should conscientiously search for weak links and blank spots in the standardized construction of law enforcement in their own regions, departments, and types of police. In particular, they must conduct research on the links that are most prone to problems in current law enforcement activities, and study the weak links and blank spots found in the survey. Formulate clear operating procedures and law enforcement standards, improve various management systems, and ensure that the police have laws to follow and rules to follow in various law enforcement activities and in all aspects of law enforcement.
(4) Vigorously strengthen the standardization of law enforcement behavior
13. Improve the case legal review and check system. In accordance with the principles of “whoever approves, who is responsible”, “whoever enforces the law, who is responsible”, and “unity of powers and responsibilities”, further clarify the subject of legal review, determine the scope of cases and law enforcement links, and improve the case legal review system. It is necessary to establish a filing system for different opinions, and record the different opinions in legal review and case deliberation as the basis for law enforcement inspection and accountability. Where a wrongful case is caused by not adopting a correct opinion, the person who put forward the correct opinion shall not be held accountable. It is necessary to strengthen the construction of part-time legal system members in grassroots units and teams, and give full play to their important role in case review and check.
14. Carry out the work of standardizing discretion. All units should continue to do a good job in standardizing discretionary power, refine and quantify administrative discretionary power according to the actual social and economic development, clarify specific law enforcement standards, reduce the space for discretionary power, and combine the legal effects of law enforcement with social effects, so that the people The masses are satisfied.
15. Extensively carry out activities to cultivate and create law enforcement demonstration units.
